Event Waiver
Please carefully read the waiver and make sure you are aware the registration fee is non-refundable.
Waiver of liability for the Army Benevolent Fund: Pyrenees Escape Route 2024.
Please read this document carefully before agreeing. This document has legal consequences and will affect your legal rights and will limit or eliminate your ability to bring future legal actions.
In consideration of being permitted by Trek Pyrenees to participate in this trekking event "Pyrenees Escape Route 2024." ("Event"), including related programs, I understand and acknowledge that by checking the box below or signing below, that I am legally agreeing to the statements in the following Release and Waiver of Liability, and Assumption of Risk and Indemnity Agreement. I hereby freely and voluntarily acknowledge and/or take action for myself, and on behalf of my spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns, or anyone else who might claim or sue on my behalf, as follows:
- Risks
I HEREBY ACKNOWLEDGE AND ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS EVENT.
I certify that I am physically fit, will sufficiently train and prepare for this Event and have not been advised otherwise by a qualified medical person or other healthcare provider. I have no physical or medical condition that would endanger myself or others if I participate in the Event, or would interfere with my ability to safely participate in the Event.
I acknowledge that this trekking or athletic Event is an extreme test of a person’s physical and mental limits and carries with it the potential for death, serious injury and property loss.
The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of trekkers or athletes, lack of hydration, equipment, vehicular traffic, actions of other people including, but not limited to, participants, Event team support staff /crew, and/or organisers of the Event. The risks are not only inherent to trekkers, but are also present for volunteers and support staff. I hereby assume all of the risks of participating and/or volunteering in this Event.
- Liability
In consideration of my application and permitting me to participate in this Event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(I) Waive, Release and Discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this Event, THE FOLLOWING ENTITIES OR PERSONS: Trek Pyrenees, their directors, officers, employees, volunteers, guides, representatives, and agents, the Event holders, suppliers, Event sponsors, Event directors, Event volunteers, all country, city, town, county or equivalent, and other governmental bodies, and/or municipal agencies whose property and/or personnel are used and/or in any way assist in locations in which the Event, Trek or segments of the Event take place, and each of their respective parent, subsidiary and affiliated companies, licensees, officers, directors, partners, board members, shareholders, members, supervisors, insurers, agents, employees, volunteers, and other participants and representatives (Released Parties);
(II) Indemnify and Hold Harmless the entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of any of my actions during this Event;
(III) I further covenant and agree not to sue any of the Released Parties for any of the claims that I have waived, released, or discharged herein.
- Medical treatment
I hereby authorise Trek Pyrenees or any of its agents, employees, volunteers, affiliates and designees, any organizer or sponsor of the Event, or any Event volunteer, to consent to receive or give medical treatment or first aid assistance which may be deemed advisable in the event of injury, accident and/or illness during this Event by a medical director or any of its agents, employees, volunteers, affiliates and designees, a physician and/or hospital. I understand that this authorization is given in advance of any specific diagnosis, treatment, or hospital care being required, and is given to provide authority and power to render care which the above-mentioned may deem advisable in the exercise of their best judgment. I agree to be responsible and assume liability for any and all costs incurred as a result of my participation in the Event, not covered by my insurance, including but not limited to, medical care and treatment, ambulance services, rescue and repatriation, hospital stays, and physician and pharmaceutical goods and services. I agree to abide by any decision on any guide as to my ability to safely complete the Event. I realise that costs associated with rescue, repatriation and medical care must be covered by myself and / or my insurance for the event.
I confirm that I am aware that the Event is a physically challenging event, and will prepare for it as such. I will declare all pre-existing medical conditions and any medication I am taking prior to the Event.
I confirm that I am aware that if I will be over 65 on the start date of the Event I need to get sign off from my GP to take part in the Event. I am aware this form needs to be sent to the Charity or Trek Pyrenees by the 30th June 2024. I am aware that a digital copy of this declaration will be made and stored securely, for the period of time required by law.
COVID-19 Acknowledgement
I hereby acknowledge and understand that the coronavirus (“COVID-19”) is extremely contagious and easily spread through air, person-to-person contact, and contact with contaminated objects. People can be infected and show no symptoms yet still spread the disease, which can cause serious and potentially life-threatening illness and even death.
Further, I knowingly and agree to follow all required and relevant activity guidelines and recommendations to maintain the health and safety of event attendees. I acknowledge that failure to comply with these practices may result in exposure to, or contraction of, COVID-19 and may put others at risk. Prior to the event, I acknowledge and agree that I will fully and truthfully fill out and sign any waivers, releases, and/or questionnaires, booking forms that may be required of me by the Charity as a condition of my participation.
- Media
I also understand that at this event or related activities, I may be photographed, filmed and/or videotaped. I agree to allow my name, photo, video or film likeness to be used for any legitimate purpose by Event holders, producers, sponsors, organizers and assigns.
I am aware that photos will be used for public consumption and the Army Benevolent Fund branding is recommended for group photos. Participants wearing other Charity branding or clothing deemed ‘offensive’ may not be included in group shots or may be asked to conceal said branding.
- General
I understand that Trek Pyrenees reserves the right, in its sole and complete discretion, to deny entry, revoke the entry application of any applicant at any time, and/or to retire any individual from the Event in the interest of safety of the participant and / or other participants taking part in the trek. Applicant expressly waives any claim for damages arising from the denial of an entry application. Where an applicant is asked to withdraw in the interests of safety part way through the event or trek, no refund will be provided.
I acknowledge and agree that Trek Pyrenees its sole discretion, may delay, modify, or cancel the Event itinerary if it believes the conditions on the event or trekking day are unsafe. In the event the Event is delayed, modified, or cancelled for any reason, including but not limited to acts of God or the elements (including without limitation, wind, fog, rain, hail, hurricane, tornado, earthquake), acts of terrorism, fire, threatened or actual strike, labour difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, race course conditions, or any other cause beyond the control of Trek Pyrenees there shall be no refund of Trek Pyrenees deposit fee or any other costs incurred in connection with the Event.
I acknowledge that this Accident Waiver and Release of Liability (AWRL) form will be used by the event holders, sponsors and organizers, in any event in which I participate and that it will govern my actions at said events. It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. This AWRL shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I certify that I have read this document and I understand its content.
I understand that third parties who have not signed up to the Event will not be able to take part in any day, section or aspect of the Event without express prior consent from Trek Pyrenees. This consent is not guaranteed and likely only to be given in exceptional circumstances. I understand that any third parties will be turned away irrelevant of any costs already incurred to the party.
Code of Conduct
While taking part in an overseas challenge event I understand that I will be perceived as representatives of the Army Benevolent Fund and Trek Pyrenees and agree to adhere to local laws and customs regarding their behaviour and conduct.
Trek Pyrenees reserve the right to dismiss from the programme any participant who is deemed to be a danger to themselves or others, or whose conduct is deemed to be detrimental to the programme or other participants. In the event of this case, I will not hold Trek Pyrenees responsible for any costs incurred by the participant and no fees will be refunded.
- Communications & Data
I understand and agree that by submitting an online registration to participate in this event, I am consenting to receive email and postal communications from the Army Benevolent Fund regarding The Event. I acknowledge that it is my responsibility to ensure emails regarding my participation in the event sent by the Army Benevolent Fund and/or event organisers (including but not limited to email receipts, tickets and advanced notices) are received by me, and are not redirected to Spam or Junk folders or sent to email addresses I do not have access to.
I acknowledge that my data will only be available for Trek Pyrenees for processing in relation to the Event.
I acknowledge that if I am required to provide a declaration from my Doctor that a digital copy of this will be securely stored and kept for the period of time required by law.
I acknowledge that my data will only be used for marketing purposes, including but not limited to electronic marketing, if I provide specific consent for this during the registration process.
I understand that I may unsubscribe from any marketing lists I do opt in to receiving at any time, either by using the link provided in e-mails or by calling the Army Benevolent Fund at any time.
I am aware that the Army Benevolent Fund will never sell or otherwise distribute my details to any third party, except in regards to providing health and safety data to the event organisers for use in that respect only. - Registration fee, Fundraising & Withdrawals
I confirm that I am aware that the registration fee is non refundable.
I agree to commit to raising at least £2,200 for the Army Benevolent Fund, £550 of which must have been raised by the 30th June 2024, and that the registration fee and gift aid are not included in this amount.
I am aware that if I do not reach this amount by the 30th June 2024 I will not be able to participate in the event and my registration fee will not be refunded.
I confirm that I am aware that all of the information requested during registration will need to be provided before the 30th June 2024 or my place in the Event will be withdrawn and my registration fee will not be refunded.
I agree that once accepted, my place cannot be cancelled unless I provide a written request to do so. I am aware that I can only transfer my registration fee to any other person if the Charity receives written notice of the change by the 30th June 2024. This is subject to the other person providing all information required during registration, including any medical signoff if required by the agreed deadline, which in this case is also 30th June 2024.
I am aware that if I must withdraw from the event before the 30th June 2024 any deferral to a future event is at the discretion of the Charity. If I must withdraw after the 30th June 2024 my registration fee is forfeited and I will not be able to transfer my place to a future event or an alternative the Army Benevolent Fund event. I am aware that individual donors are entitled to a refund if they directly provide a written request to the Charity. Any resulting refunds of fundraising will only be made directly to the donors themselves.
I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, I HAVE READ THIS AGREEMENT, I UNDERSTAND ITS CONTENT, AND INTENTIONALLY AND VOLUNTARILY SIGN THIS AGREEMENT.
